Stages of Grievance redressal for Life & Health insurance

The stages of an insurance complaint for Life and Health Insurance in India follow a structured, multi-tier grievance redressal system established by the IRDAI and the Council for Insurance Ombudsmen.

Stage 1: Complain to the Insurance Company (Grievance Redressal Officer)

• File a Written Complaint: Send a formal written complaint directly to the insurance company’s customer care, branch, or designated Grievance Redressal Officer (GRO) via email or their official website. Keep a copy of the complaint reference/token number. • Timeline for Insurer to Respond: The insurance company or broker must review and address your complaint within 14 to 30 days (typically within 15 working days or up to 30 days depending on the nature of the policy).

Stage 2: Escalate to IRDAI (Bima Bharosa Portal)

• Register on the Portal: If the insurer fails to respond within the timeframe, rejects the complaint, or provides an unsatisfactory resolution, you can escalate the matter to the Insurance Regulatory and Development Authority of India (IRDAI). • Bima Bharosa: File your grievance online through the Bima Bharosa Portal (which replaced the old IGMS system) to receive a tracking token number. • Toll-Free Support: You can also contact IRDAI’s toll-free helpline at 155255 or 1800-4254-732, or email complaints@irdai.gov.in.

Stage 3: Approach the Insurance Ombudsman (Bima Lokpal)

If your grievance remains unresolved or if you are unhappy with IRDAI/insurer feedback, you can approach the Insurance Ombudsman under specific conditions: • Eligibility Criteria: o You must have first filed a written complaint with the insurer. o The insurer must have rejected it, offered an unsatisfactory partial settlement/response, or failed to reply within 30 days. o The claim value (including expenses) must not exceed ₹50 lakhs. o You must file the complaint within 1 year of the insurer’s rejection date or 30-day non-response window. o The matter must not currently be pending or decided in a consumer forum, court, or arbitration. • Ombudsman Proceedings Stages: 1. Recommendation Stage: The Ombudsman reviews the facts and facilitates a mutual mediation/recommendation. If you accept it, the insurer has 15 days to implement the settlement. 2. Award Stage: If mediation fails, the Ombudsman passes a formal, legally binding Award within 3 months. The insurer must comply within 30 days. Note: Filing with the Ombudsman is completely free of cost.

Stage 4: Consumer Court / Legal Action

• If the claim amount exceeds ₹50 lakhs or you wish to challenge an Ombudsman decision further, you can approach the appropriate Consumer Disputes Redressal Commission (Consumer Court) or a civil court, where formal filing fees may apply.
